MANGAS GAMING MALTA LIMITED GENERAL TERMS AND CONDITIONS

General rules

1.1

Mangas Gaming Malta Limited is a limited liability company that runs and manages the website and brand EXPEKT.COM. Use of our website, registration with us and the use of any services we offer is subject at all times to acceptance on your part of these Terms and Conditions. Registration on the site, any use of the services offered and all bets accepted by EXPEKT.COM are subject to these terms and conditions.

1.2

EXPEKT.COM reserves the right to amend these terms and conditions at any time without prior notification. All editions will show version number and validity start date.

1.3

EXPEKT.COM reserves the right to refuse the whole or part of any bet and to make ambiguous bets void. No bets will unreasonably be declared void.

1.4

All references to the ‘Authority’ in this document shall be deemed to refer to the Lotteries and Gaming Authority of Malta.

1.5

All references to ‘we’ and ‘our’ shall refer to Mangas Gaming Malta Limited or EXPEKT.COM according to the context in which they are stated.

1.6

We shall treat any breach of these Terms and Conditions as a serious matter and we may take any steps at law which we deem fit and proper to protect our interests.

The client

2.1

No person under eighteen years of age may be registered at EXPEKT.COM as a player and any funds deposited or any money won by any such persons will be forfeited to the Authority.

2.2

EXPEKT.COM reserves the right to refuse to open a betting account.

2.3

Expekt.com reserves the right to close an account in its sole discretion. In such cases, any funds will either be remitted to the player or transferred to the Authority depending on the circumstances.

2.4

Residents of the USA, Malta and Turkey are not allowed to open an account. Internet gambling may be wholly or partially restricted in some jurisdictions. If internet gambling is illegal in your jurisdiction you are not authorised to complete your registration or open an account. Expekt.com accepts no responsibility for internet gambling from residents in jurisdictions where it is illegal.

2.5

Mangas Gaming Malta Limited reserves the right, at all times, to transfer and/or license, without prior notice, right, liability and/or operation of an EXPEKT.COM account to another legal entity, subject to EXPEKT.COM guaranteeing the fulfilment of the transferred liability.

2.6.

(1) It is obligatory for customers when registering with us to:
- Register in their own name and surname giving accurate, correct, complete and up to date details;
- Register with correct, complete, accurate and up to date place of residence;
- Register with a valid e-mail address;
- Register with a correct fixed line home/mobile phone number.

(2) We reserve the right to immediately close any accounts if it emerges that the information provided is inaccurate or insufficient.

(3) Customers are only allowed to open one account. Opening of multiple accounts is not permitted. Should we have reasonable suspicions that any of our customers has opened multiple accounts with us we reserve the right in our absolute discretion to freeze that customer’s account or to close the account immediately and the customer shall forfeit all his winnings. Customers should also note that their original deposits will not be refunded. Customers shall also be liable towards Mangas Gaming Malta Limited for damages and costs incurred as a result of the fraud.

2.7

We specifically do not permit our customers to do any of the following:

- To act on behalf of another person or third party;
- To deposit money originating from criminal activity;
- To deposit money through a credit card which a customer is not authorized to use, or knowingly receiving money from such card on in any other manner colluding with a third party to so do;
- To use in any manner whatsoever their player account or that of third parties for money laundering or any other illegal purpose.

2.8

We strictly prohibit the use of robotic, mechanical, or electronic, or other devices to automatically make decisions in any game, whether such use is attempted or effected by one of our customers or by as a guest or by any third parties.

2.9

If deposits effected are not used for the sole purpose of gaming or wagering and in EXPEKT.COM’s discretion there is suspicion of abuse (for instance where an appropriate level of game play has not occurred) the customer shall be deemed to be abusing exchange rate fluctuations and EXPEKT.COM reserves the right in its absolute discretion to cancel the respective deposit/s in part or in full and to retract any costs that may have resulted in conjunction herewith. EXPEKT.COM also reserves the right to close that account indefinitely.

Accounts

3.1

In order to use the services offered at EXPEKT.COM the customer must have a valid account with sufficient funds in it to participate.

3.2

(1) A request for the opening of an account with us is effected by adequately completing the Registration Form on our website and sending it to us.

(2) Customers are to note that funds deposited into a player account do not earn any interest.

3.3

(1) The minimum deposit which must be effected into an account is that of 5 EURO or the equivalent in another currency for credit card deposits. Other minimum deposit amounts differ depending on the payment option. For more information please visit the deposit pages on our site.

(2) Expekt.com reserves the right in its sole discretion to amend both its deposit and its withdrawal limits

3.4

(1) Customers may effect deposits into their account in any one of the currencies indicated on our web site.

(2) We do not charge deposit fees on any transfer, except those effected through credit cards where a processing fee of up to two point five per cent (2.5%) is debited to your account. (Solo/Switch/Maestro debit incurs no charge).

(3) Funds deposited in one account cannot be transferred to another account.

(4)Customers cannot change the currency of their account once the first deposit has been made.

3.5

Payout from the customer´s account with EXPEKT.COM will be made through the customer's bank account or to a credit card used for deposit (VISA only).

3.6

(1) We reserve the right to request a clear and legible photo copy of your VISA/Mastercard and/or bankstatement and/or picture identity card (ID) or passport and/or any other official personal identification document which we deem fit in order to ascertain and verify your age and identity and this at any time and especially prior to processing your withdrawal.

(2) When we request documentation from our customers we direct our customers to send such documentation to documents@expekt.com, we recommend that customers send us their official personal identification documents even if this is not requested as this will facilitate matters at withdrawal stage. Customers wishing to send us such documents of their own free will may do so by emailing them to documents@expekt.com

(3) Where for any reason our customer refuses or is unable to provide us with any of the requested documents, we reserve the right in our sole, absolute discretion to freeze that customer’s account or to close the account immediately and the customer shall forfeit all his winnings. Customers should also note that their original deposits may not be refunded.

3.7

Customers shall at all times remain responsible for maintaining and protecting the secrecy of their accounts. Customers should not allow third parties access to or use of their account. Any losses due to this shall not be refunded by us and we shall not be responsible in any manner whatsoever. In this regard we guide your attention to our Privacy Policy which you should read carefully together with these Terms and Conditions.

3.8

The customer shall not allow any third party using the customer's login details. The customer accepts full responsibility for the consequences of allowing such activity and, without derogating from the generality of any other indemnity contained herein, indemnifies and holds Mangas Gaming Malta Limited harmless in respect of any damages arising from the same.

3.9

(1) Expekt.com shall not make a payment in excess of two thousand five hundred Euro (€2,500) out of a customer’s account, to such customer, until the company is satisfied that the identity, age and place of residence of the customer have been suitably verified.

(2) Upon the slightest indication of transactions and/or activities indicating potential money laundering we shall report to the relevant authorities.

3.10

If no transaction has been recorded on a customer's account for thirty months, Expekt.com will remit the balance in that account to the customer, or if the customer cannot be satisfactorily located, to the Authority:
Provided that no claim shall lie against Expekt.com who has remitted the balance in a customer's account to the Authority.

3.11

Limits set by player
A registered customer may by written notice or electronic notice to Expekt.com;
- limit amounts wagered/lost

- exclude the customer from playing for a definite or indefinite period of time;
- limit the amounts deposited during a set period of time
- A customer who has set a limit or exclusion under this regulation may change or revoke the limit or exclusion by written notice or electronic notice given to Expekt.com.

- A notice increasing or revoking a limit or decreasing the exclusion has effect only after seven days after Expekt.com has received the notice.

- A notice reducing a limit or increasing the exclusion has effect immediately after it is received by Expekt.com.

- Expekt.com will not accept a deposit from a customer contrary to a limit or exclusion set by the customer under this regulation.

Bets

4.1

The minimum bet is EUR 0.10 or the equivalent in another currency.

4.2

Credit bets are not accepted. The necessary funds must be deposited into to the customer's betting account before the bet will be accepted by EXPEKT.COM.

4.3

(1) As our Customer you declare that: - You do not know or are not aware of the outcome of the event when placing the respective bet.

(2) The live betting schedule can be amended at any time due to changes in transmission plans by broadcasters.

(3) Should a bet be placed at an incorrect price due to delayed ‘Live’ coverage of an event and where a team has gained a significant advantage, bets will be voided.

(4) Where we have reason to believe that a bet has been placed after the outcome of an event is known (even if it is known just to the person placing the bet) we reserve the right to void the bet.

(5) We reserve the right to suspend betting during an event due to failed transmission or other technical related issues or if we suspect fraud.

(6) We will determine the deadline for the placing of bets at our discretion.

(7) We shall not tolerate deliberate and repeated incidents of late betting. We consider this to be fraud and we will deal with it accordingly.

(8) We further reserve the right to cancel bets even subsequently if any such bet was won by the customer as a result of a technical fault or error, inclusive of but not limited to an error or fault in transmission. In any such case, the stake of the bet or game shall be re-credited to the player’s account. Nevertheless we reserve the right to hold a customer liable for any damage caused to or suffered by us as a result of such customer knowingly taking advantage of a technical or administrative error when making and/or receiving payments.

(9) If, during the period of acceptance of bets, information becomes known through which the result of the bet can be determined, the deadline for acceptance of bets will be determined anew or the bet will be cancelled and this in our absolute discretion.

(10) We assume no responsibility for typing, transmission and/or evaluation errors. In particular, we reserve the right to correct obvious errors with the input of betting odds and/or the evaluation of betting results even after the event - or to declare affected bets void.

(11) We do not assume liability for correctness, completeness or up-to-dateness of the information services provided. Although we will endeavor to ensure that the information/data we provide is correct and accurate, if an error is made be it a human error or an error resulting from technical problems we do not assume any liability whatsoever resulting from that error or from reliance on anyone’s part of our data. The company also assumes no liability for the accuracy of live scores, statistics and intermediate results in live betting.

(12) It is the customer’s responsibility to notify our support services immediately should funds be credited to their EXPEKT.COM account in error. Should this occur, these funds are not available for use and we reserve the right to withdraw these funds and to void any transactions placed using them.

4.4

If EXPEKT.COM accidentally accepts a bet after the time in 4.3, then EXPEKT.COM reserves the right to declare the bet void.

4.5

EXPEKT.COM reserves the right to refuse the whole or part of any bet and to make ambiguous bets void. EXPEKT.COM will inform the customer by e-mail, phone or telefax and the intended stake will be left on the customer's betting account. Where a selection is made void, in Single bets the stakes will be returned. In accumulative bets the stake will stand for the remaining selections with a Double becoming a Single, a Treble becoming a Double etc.

4.6

Customers must register their bet requests as individuals. Repeated requests containing the same selections from the same or different customers may be subsequently deemed void in the following circumstances:

4.6.1

Where EXPEKT.COM believes the customers are acting in collusion or as a syndicate.

4.6.2

Where bet requests are registered within a short time of another.

4.7

In any one of the cases in 4.6 EXPEKT.COM may pay out only an amount that would have been accepted for one customer placing one bet.

4.8

All bets are subject to acceptance by EXPEKT.COM and will be confirmed to the customer at the time the bet is made.

4.9

A bet will stand even if the contestant does not start or if he aborts the contest, unless stated otherwise.

4.10

The customer must ensure that he understands the terms of the registration of the bet request, including the Rules section, before he confirms the placing of the bet.

4.11

In special cases, EXPEKT.COM may verify a bet in writing, by e-mail, by post or by telefax before it is accepted.

4.12

When placing a bet on the Internet, you are solely responsible for your own account transactions. Please be sure to review your bets for any mistakes before sending them in. Once a transaction is complete, it cannot be changed. Expekt.com does not take responsibility for missing or duplicate wagers made by the customer and will not entertain discrepancy requests because a play is missing or duplicated. Customers may review their transactions in the Pending section of the site after each session to ensure all requested wagers were accepted.

4.13

All bets struck with EXPEKT.COM are considered to be placed and received in Malta. Any contract(s) between Mangas Gaming Malta Limited and the customer are deemed to have been formed in Malta.

4.14

By playing any game at Expekt.com, the customer warrants that the customer is familiar with the rules of such game and acknowledges that the rules of each game are available through using the “rulessection” in the sportsbook, Help section in the pokerclient or the “Gameinfo” section in the Casino window.

Wins

5.1

The maximum win per bet/systembet is limited to EUR 55.000 or the equivalent in another currency.

5.2

Customers are not permitted to make multiple bets using the same or similar combination of events if the possible win is higher than that stipulated in 5.1.

5.3

All winnings will be credited to the customer´s account with EXPEKT.COM.

5.4

Winnings will normally be paid out in the currency of the customers account.

Odds

6.1

EXPEKT.COM offers only fixed odds betting. All bets will be settled at the odds on offer when the bet was placed. EXPEKT.COM reserves the right to change the odds at any time.

6.2

All odds are valid on actual results at the end of play. Extra time does not count unless otherwise stated.

6.3

If a game is abandoned or cancelled, it will be considered void and the odds will be set to one (1.0) unless otherwise stated.

Events

7.1

A game that is postponed by more than 36 hours will be treated as void unless otherwise stated. The odds for such a game will be set to one (1.0) for settling purposes.

7.2

Any suspected irregularities in the game or sporting event may lead to EXPEKT.COM withholding payments until a full investigation has taken place. Any such investigation will be carried out by Expekt.com in cooperation with the relevant governing body and/or independent authority. Any bets placed on such events may be declared void and the stakes returned.

7.3

Customers are not permitted to place bets, directly or indirectly, on events in which they are participating in any manner whatsoever. This includes, but is not limited to sports-players, coaches and club or team managers or employees. Expekt.com reserves the right to take all necessary actions, particularly those specified under these General Terms and Conditions, in case a breach of this rule is intercepted or brought to our attention.

7.4

For security reasons, your personal data will not be passed on to third parties in any form whatsoever as a matter of principle, unless of course you give us permission to do so. So as to aid the prevention of match or price rigging, we reserve the right to relay a suspected offender’s saved details (information pertaining to the reservations or suspicions of the respective misdemeanour in question) to sporting bodies, authorities or any other third party, which deals with the investigation of such offences. The company naturally fulfils the valid legal regulations for the collection and processing of personal information.

Errors and omissions

8.1

Mangas Gaming Malta Limited is not responsible for printing errors that may occur on the web site expekt.com and printed material.

8.2

Expekt.com reserves the right to cancel any bet made on an obviously "bad" line or a wager made after an event has started.

Exclusion and Limitation of Liability

9.1

The contents of EXPEKT.COM World Wide Web pages are provided "as is". Except as required by applicable law no warranty of any kind, either express or implied, is made in relation to the accuracy, reliability or content of the pages. Mangas Gaming Malta Limited reserves the right to revise the pages or withdraw access to them at any time.

9.2

Mangas Gaming Malta Limited assumes no responsibility for material created or published by third parties that EXPEKT.COM World Wide Web pages have a link to.

9.3

In no circumstances will Mangas Gaming Malta Limited be liable for any indirect or consequential loss however caused.

9.4

Mangas Gaming Malta Limited shall not be liable for computer malfunctions, failure of telecommunications service or Internet connections nor attempts by you to participate in games by methods, means or ways not intended by us.

9.5

Although we shall take all reasonable measures to ensure that the Software and files are free from computer viruses we cannot and do not guarantee that the Software and files are free of such problems. We will restore the Service, as soon as is reasonably practicable, after temporary suspension.

9.6

We may temporarily suspend the whole or any part of the Service for any reason at our sole discretion. We may, but shall not be obliged to, give you as much notice as is reasonably practical.

9.7

Mangas Gaming Malta Limited's liability towards a customer shall be limited to the amount of the relevant stake or the amount in the customer's betting account whichever is the lesser.

10.1

By accessing EXPEKT.COM World Wide Web pages you agree to the terms and conditions of this agreement. You must not access our pages if you do not agree to these terms and conditions. Regarding the terms and conditions of any bonus program we direct you to our bonus page.

If bonus requirements haven't been met within six months (unless another term has been set in the bonus specific terms and conditions) from when the bonus was first taken, the bonus will be canceled and deducted from the account.

10.2

The contents of EXPEKT.COM World Wide Web pages are copyright (c) Mangas Gaming Malta Limited. All rights reserved. Reproduction, transfer, distribution or storage of part or all of the contents in any form without the prior written permission of Mangas Gaming Malta Limited is prohibited except in accordance with the following permission. Individual documents in our World Wide Web pages may be subject to additional terms indicated in those documents.

10.3

The customer acknowledges that the Poker software, the "get-up" of the Poker and all material which may be visually or audibly presented to the customer in the customer's use of the poker room is either the intellectual property (including, but not limited to, copyright, domain name rights and trademarks) of the poker room or its licensor's and in this regard the customer acknowledges that it has no rights whatsoever to use or lay claim to any intellectual property belonging to the poker room and/or its licensors.

Miscellaneous

11.1

As a condition of your use of this Web site, you warrant to Mangas Gaming Malta Limited that you will not use this Web site for any purpose that is unlawful or prohibited by these terms, conditions, and notices.

11.2

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

11.3

11.4

In the event of there being a discrepancy between the English language version of these terms and conditions and any other language version, the English language version will prevail.

11.5

All terms&conditions regarding poker is written under “help” in the pokerclient, it is your responsibility to read and accept these terms before you start play poker in the pokerclient.

11.6

All terms & conditions regarding Supertoto is written under the “rules” section in the Supertoto page. It is your responsibility to read and accept these terms before you start playing Supertoto.

11.7

Any rights not expressly granted herein are reserved.

11.8

This agreement is governed by the laws of Malta.

11.9

(1) The Lotteries and Gaming Authority (LGA) of Malta is the regulatory body supervising the operation of Mangas Gaming Malta Limited. Mangas Gaming Malta Limited holds the following Maltese licenses: LGA/CL1/132/2000 (for Casino and Games), LGA /CL2/132/2000, Class 2 (for Bookmaking)and class 1 on Microgaming class 4 (for Casino).

(2) Our Poker is governed by the license issued by the Kahnawake Gaming Commission on 17 July 2009.

(3) Our Supertoto is operated by Monnet Enterprises Limted which is a company licensed and regulated in Malta by the Lotteries and Gaming Aurhority under license number LGA/CL2/208/2005.

11.10

Any complaints regarding our handling of any matter should be addressed to support@expekt.com. If you still feel that your matter has not been resolved to your satisfaction, you should turn to the Authority which can be reached on the following email address complaints@lga.org.mt

11.11

Mangas Gaming Malta Limited is governed by the laws of the Republic of Malta including the Data Protection Act of 2001. With reference to data protection issues we direct you to read our Privacy Policy carefully.

11.12

Mangas Gaming Malta Limited is a company incorporated in Malta with its registered address being 114 The Strand, GZR1027, Gzira, Malta.
